Terms of Service
CLIENT ROLES + RESPONSIBILITIES
Website design is a collaborative process. Tess by Design believes successful design happens when there is open, supportive, and honest communication between Designer and Client.
It is the responsibility of the customer to review in full all proposals for website development, website design, and other services provided by Tess by Design.
It is the responsibility of the Client to review the project timeline and adhere to the dates for deliverables on their part. Failure to meet deadlines will delay the final publication of the site. Client releases Designer from liability for delays should Client fail to commit to deadline of deliverables. Long delays may result putting the project on hold.
Just as the Designer is held to ethical practices and standards, similar is expected of the Client. Any material submitted for web site publication will not contain any unethical or abusive material including spamming, obscenity, computer viruses, violations of privacy, plagiarized or copyrighted material. Client agrees to hold Designer harmless from any claim resulting from the Client’s publication of those materials.
REVISIONS
Number of revisions will vary depending on scope of project.
Only Client may approve revisions. Only the Designer may make revisions prior to the final publication of the site.
SCHEDULE + COMMUNICATION
Designer’s hours: Monday-Friday 8:30 a.m. to 4:30 p.m.
*Designer’s availability may vary due to other professional and volunteer commitments.
Designer and Client will communicate via *email (preferred), by scheduled phone or in-person meeting. In-person consultation meetings will resume post-COVID.
Messages sent to Designer after 3:00 p.m. CST may not be received until the next business day.
REFUND POLICY
One-hour consultation (by appointment only) is free.
Non-refundable deposit is due to begin the project. Fee is *twenty-five percent (25%) of final total payment is due within 10 days of signing Letter of Agreement.
Should Client adamantly request a refund, a written request (email acceptable) must be submitted within 3-5 calendar days of the publication of the website. All changes to the website will be deleted and website will revert to "original" version. Any stock photos, fonts, sketches, design ideas, copy written material will belong to the Designer.
Should Client need additional changes outside of what was previously agreed upon, Designer reserves the right to determine the number of changes that can be made.
PORTFOLIO DISPLAY RIGHTS
Client grants permission for Designer to display work in portfolios upon completion of project.
LIMITATION OF LIABILITY
Client agrees that they shall not hold the Designer for any incidental or consequential damages that arise from the Designer’s failure to perform any aspect of the project in a timely manner, regardless of whether such failure was caused by unintentional, intentional or negligent acts or omissions of the Designer or Client, any client representatives or a third party.
